Mitirho Works (Pty) Ltd (the Company), Registration Number 2020/711158/07, owns and operates this online store and website at the domain name www.daily.store.

By viewing, continuing to view, accessing, using and/or shopping from this website, you (the Customer) acknowledge that you have read these terms and conditions and that you agree to be bound by these.  The Customer also agrees that the Company may communicate via e-mail with the Customer on any Order placed by the Customer. 

You also understand if you have questions about these terms and conditions or any other aspect of the website or our Products, you will reach out to us to have these answered.  Use the contact form for this purpose. 


These Terms and Conditions govern the

This website is operated and managed by the Company from its offices in South Africa.  These terms and conditions, therefore, are governed by the laws of the Republic of South Africa.  The Customer consents to the jurisdiction of the Johannesburg Magistrates Court of the Republic of South Africa.

 

1.   Sales Terms and Conditions

The terms and conditions on this site govern the supply of any Product or Service ordered by the Customer through this website. "Product” or "Service" means any item sold on the website. By ordering and paying for a Product or Service the Customer agrees to be legally bound by these terms and conditions. 

1.1.   Price and payment

  • The Company reserves the right to set and change the price of all products and/or services offered on the website.
  •  All prices on the website are in South African rands and include VAT. These prices do not apply to Customers outside of the Republic of South Africa. The price listed against a Product on this website does not include delivery costs.  These are calculated at checkout. 
  • The Company makes every effort to ensure that the prices as displayed on the website are correct and valid. In the unlikely event that the price is displayed incorrectly, the Company reserves the right to correct it on the website and to communicate the error to the Customers who purchased the Product with the incorrect price. If the Customer is unwilling to purchase the Product at the correct price, the Company will reimburse the Customer in full.
  • All Products remain the property of the Company until payment is received in full. Payment by Electronic Fund Transfer will only be considered received once it reflects in the Company’s bank account. Products will only be released for delivery or collection once full payment for purchased products and delivery costs (where applicable) is received and the receipt is confirmed by our bank.
  • For the security of the Customer’s payment information, all payments must be made using the website’s payment gateway, Payfast.  This allows Customers to pay for their Products through an electronic funds transfer or by using their debit or credit cards, their RSC card or their Mobicred account.

 1.2.  Delivery

  • The Courier Guy is our delivery partner, however, the Company reserves the right to use other partners should the need arise. The Company does not guarantee that delivery can take place to every corner of South Africa, but we will work with our delivery partners to make our reach as broad and as inclusive as possible.
  • The Company will only deliver to the address provided by the Customer at checkout. Deliveries will be made between Monday and Friday, except for public holidays.  Deliveries will take place during working hours only. 
  • The Customer is responsible for the cost of delivery or collection from our warehouse in Stormill, Johannesburg. The cost of delivery is calculated when checking out. These costs are calculated on delivery from Johannesburg to other major centres in South Africa.  If the cost of delivery exceeds the amount calculated when checking out, the customer will be informed, and the balance is payable to the Company, or the customer can arrange with his/her own courier/transport company to collect the Products.
  • The Company’s delivery partner will communicate with the Customer to provide an estimation of the delivery date and a tracking number.  The Company shall not be liable for delivery delays that are outside of its sphere of control. 
  • Products will only be dispatched once full payment for the order has been received. 
  • The Customer is responsible to ensure that delivery is possible both in terms of access to the point of delivery and also that someone on the property is available to accept delivery.  If delivery is not possible, the Customer will liaise with our delivery partners to facilitate the delivery of their order.
  • The Customer understands that the Products, unless stated otherwise on the website, are flat-packed and will be delivered that way.  The Customer is responsible for assembling the Products they ordered.

 1.3.   Collection

  • If the Customer elected to collect their order, they may do so from the Company’s premises within 7 days of receiving written notification from the Company that the Products are ready for collection. 
  • The Customer will be required to provide an order number for the order being collected as well as identification in the form of either a valid driver’s license, a passport or ID document.

 1.4.    Cancellations and Refunds 

  • If the Customer ordered a Product or Products with popular finishes (for example colour, stain or fabric). the Company, at its discretion, will allow a cancellation.
  • If, however, the Customer ordered a Products or Products with less popular finishes and production has commenced on the order, a cancellation will not be allowed.  
  • Where a cancellation is accepted by the Company, the Customer will be refunded in full.  All refunds will be made into the account from which payment was made.  Bank confirmation regarding the banking details may be required in order to process the refund.
  • All refunds will be made within 30 days of cancelling the order.  This applies to refunds on Products returned as well.

 1.5.   Returns

  • Where a product does not require personalisation or customisation in any way, there is a "cooling-off" period of 7 days of receipt of the Product to return it, provided they are unassembled, unused, undamaged, and sealed in their original packaging. In such a case, the customer will bear the cost of returning the order. The Company will refund the customer the cost of the Products less a 10% handling fee and the delivery fee.
  •  Where a Product has been personalised or customised for the Customer (for example, colour, stain or fabric), the “cooling-off” period does not apply nor can the Customer cancel the order once it has been processed.The Customer must inspect the Products within 7 days of receipt to ensure that they are not damaged and/or that all component parts have been received. If there is damage or missing components, the Customer will give the Company written notice of the problem along with photographs (if relevant).  Such notice must be sent to sales@godaily.co.za. No word from the Customer within this period will be seen as an acceptance from the Customer that the products were received in full and undamaged.
  • If components are missing, the Company will send these to the customer at the Company’s expense as expeditiously as possible. 
  • If the Product is damaged, the Company reserves the right to ask the Customer to return the Product in its original packaging. The Company also reserves the right to inspect the Product to ensure that it is indeed damaged. The Company, at its discretion, will either replace the damaged Product, repair the damaged Product or refund the Customer after the Product has been inspected.
  • If the Customer does not follow the assembly instructions when assembling the Products and thereby damage the Products, the Company cannot be held liable.
  • All discounted or Products on sale are sold as is and cannot be returned and will not be refunded.

 1.6.   Guarantees and Warranties

  •  All timber Products are guaranteed for one year from the date of delivery.  The guarantee does not extend to Products left outdoor nor to normal wear or tear associated with the use of the Product.  Nor does it extend to the naturally occurring imperfections or characteristics of timber.  Minor cracking and changes to colour overtime can naturally take place with timber.
  • Warranties and guarantees fall away if the damage to the Products are due to negligence, misuse of the Product, or alterations have been made to the Product.  These could include and are not limited to exposure to direct sunlight, water or chemicals.
  • The colour samples of the stains on the website may appear different on different monitors and therefore, no warranties are made regarding the colour of the stains used by the Company.
  • All Products on sale are sold voetstoots without any warranties.
  • For warranty claims, the Customer will return the Product at their own expense.  After inspecting the Product and determining the extent and nature of the damage to or defect of the product, the company will either refund in full or in part, repair or replace the product.  This will depend on a number of factors such as the condition of the product and the period during which the product was used.
  • No replacement products will be considered if the Customer has had the product for more than six months.  In such a case, the Company will repair the Product and return the Product to the Customer. The cost of the repairs will be borne by the Company and the cost of delivery will be borne by the Customer.
  • The Company reserves the right to inspect the Product to assess the nature of the damage or defect and to determine if the damage is as a result of fair wear and tear, misuse or failure to use the Product in the manner in which it was intended.  If any of these are applicable the Company will not replace Product nor refund the Customer.  Returning the product to the Customer is for the Customer’s account.  If the Product is not collected within 7 days, the Company reserves the right to dispose of the Product.
  • Where a product is replaced, the warranty will only be valid for a year after the delivery date of the initial purchase.

 1.7.    Assembly of Products

  • Assembly instructions for products are included in the packaging of each product.  They are also available on the product page on the Company’s website.  The assembly of the product is the Customer’s responsibility.  The Company will assist where possible with assembly advice via telephone or e-mail.
  • The “cooling-off” period will not apply if the Product has been assembled or partially assembled.
  • The Company will not be liable for damage to the Product that occurs during the assembly of the Product

 1.8.   Limitation of Liability

  •  Use of the Products sold on this website is entirely at the Customer’s own risk. The Company will only be liable for damages that may be suffered by the Customer as a result of gross negligence or a wilful or intentional act or omission on the part of the Company.
  • The Company reserves the right to reasonably decline any order received.  In such a case, the Company will provide the Customer with a full refund.

 

2.   Terms and Conditions Relating to the Use of the Website

  • All of the content on the website, including images, graphics and text are subject to copyright and/or other intellectual property rights held by the Company. The use, reproduction, distribution, or modification of any aspect of this website is not allowed unless prior written consent is sought and given by the Company.  
  • The Customer has permission to use this site for the purpose of obtaining information on our products or services and acquiring these. 
  • Use of this website is entirely at the Customer’s own risk.  The Company takes all reasonable steps to safeguard the security of any information you provide. These steps include using secure services and encryption technology.  The Company does not accept any liability, to the extent permitted by law, for any loss or damage of any kind caused by accessing or using this website.

 

3.  Collection and Use of the Customer’s Personal Information

  • We collect information on the Customer’s use of the website.  This information includes but is not limited to browsing details on our site, your IP address, and the site that referred you.  This information is analysed in an aggregate form in order to improve our customers’ experience of our website.
  • We collect personal information on the Customer in order to process your order so that we can provide you with any products you choose to purchase from us and/or to deliver our newsletter to you. This information is protected and will not be shared or sold to any third party.
  • We do not record or store any credit or debit card details.  We use reliable and trusted payment gateways to effect the payment of all orders.
